Nation eyes laws moving toward 2010

HA NOI — The programme to build laws and ordinances must prioritise areas with urgent requirements and meet demands to be practical, feasible and scientifically-based, said National Assembly Chairman Nguyen Phu Trong.


Trong made the comment at the 19th session of the National Assembly (NA) Standing Committee, held in Ha Noi last Saturday.


Members of the NA Standing Committee commented on the Government’s proposal to build laws and ordinances in 2010, and on an appraisal report made by the NA Law Commission.


They agreed on the draft programme, which included 34 draft laws and one draft ordinance.


They also commented on the Government’s proposal to postpone the implementation of the Law on Insurance for Deposits and the revised Land Law.


The head of the Economic Commission, Ha Van Hien, and the head of the Law Commission, Nguyen Van Thuan, did not agree, saying that the draft and revised laws should strictly obey the set timeline.


NA Deputy Chairman Nguyen Duc Kien said that an amendment to the Land Law would be a necessary step to meet the current pressing requirements of the society.


It was also crucial to have clear regulations on insurance for deposits to ensure the safety and rights of the people.


Kien therefore stressed that putting the two laws into effect should be prioritised.


Head of the Justice Commission Le Thi Thu Ba and head of the Citizens’ Claims and Petitions Commission Tran The Vuong said that more attention was needed to build the Ordinance on Arrests and the Law on Complaints, since they were related to human rights and the activities of legal bodies.


Ending the session, NA deputy chairman Uong Chu Luu said it would be required to speed up the implementation of the programme to build laws and ordinances.


He also said that the draft Law on Insurance for Deposits and the revised Land Law would probably be passed at the NA’s 7th meeting, scheduled to open in October next year.


The draft law for the capital would be necessary and could be included in the official programme to build laws and ordinances in 2010.


Crucial changes


On Saturday morning, NA deputies discussed a draft law on healthcare and medical treatment.


Health Minister Nguyen Quoc Trieu said it was crucial to issue this law, given the Party and State’s stance to improve the quality of healthcare and medical treatment to better meet the demands of the people.


The draft law consists of eight chapters and 81 articles, covering areas like the rights and responsibilities of patients; physicians; clinics and hospitals and the application of advanced technologies in medical treatment. Professional mistakes and settlements related to complaints were also part of the draft law.


Most of the participants agreed on the issuance of the law.


Head of the Ombudsmen Commission Tran The Vuong said that most of thematters dealt with in the draft law were in regards to regulations on medical practices, and it would be necessary to consider issues related to healthcare workers’ ethics.


Information and communication on healthcare and medical treatment should be highlighted as important in the law, Vuong said.


The head of the Financial and Budgetary Commission, Phung Quoc Hien, said that the law editors should make clear the scope of the law and differ it from the Law on the Protection of People’s Health.


Some deputies have suggested that there should not be specific regulations for healthcare and medical treatments, which comprises four administrative levels, from central bodies to grassroots levels, including communal clinics.


They said that the State was looking to privatise healthcare services, so the sector would change in regards to organising medical practices.


There were split points of view on a regulation to forbid physicians who were State employees from opening private hospitals and clinics, or from managing them.


Some said the permission would take advantage of the education, experience and professional expertise of physicians and healthcare workers. It would also help generate more income for the physicians, causing some to leave State-owned hospitals. — VNS
